Obama Usurps Power, Flaunts Constitution

Posted by Steve Markowitz on December 1, 2013

Long before Barack Obama became president, politicians in both parties, as well as the bureaucracy in general, have attempted to obtain power not granted them under law or from the Constitution.  Certainly President Richard Nixon was guilty of such infractions.

The power grab seems to be accelerating at the presidency of Barack Obama.  While it is the president’s duty under the Constitution to enforce laws, the power to make laws reside within the Congress.  The Supreme Court is charged ensuring that the laws passed by Congress fall within the auspices of the Constitution.

Barack Obama has shown a willingness and eagerness to overstep his Constitutional authority.  There is no better example than healthcare reform.  The Affordable Health Care Act (Obamacare) was passed by Congress, signed into law by the President, and later affirmed by the US Supreme Court.  Since passage of the Act, the President has given waivers to certain constituents, delayed key parts of the law, and most recently told insurance companies that they can ignore provisions of the Act when he unilaterally allowed them to reinstate cancelled policies.

During a recent FOXNews interview, conservative commentator Charles Krauthammer took on the President concerning his flouting of the U.S. Constitution.  Krauthammer’s comments in the video below included: “I’m talking about how the administration, particularly the president, seems to think that he has right to change duly passed statutes on his own, or to suspend whole parts of laws on his own.”  he further stated: “I mean, the constitution is pretty clear, the president executes the law and the Congress passes the laws.”

We are traveling down a slippery and dangerous slope.  Once there is a breakdown in the rule of law within the government, it is hard to put the genie back in the box.  The unintended consequences of Obama’s flouting of the Constitution are hard to predict.  That does not make it any less dangerous.
